New Skilled Worker Pay-Period Rules Take Effect from 8 April 2026
Home Office tightens salary compliance for sponsored workers, requiring employers to meet minimum thresholds in each pay period—not just annually—under rules introduced 5 March 2026.
The Home Office published Statement of Changes HC 1691 on 5 March 2026, introducing new payroll compliance provisions for Skilled Worker visa sponsors that took effect on 8 April 2026. Under the new paragraph SW 14.3B in Appendix Skilled Worker, UK Visas and Immigration (UKVI) will now assess whether sponsored workers are paid at least the minimum salary threshold in each defined pay period, not just over the course of a year.
What's changed for employers
Previously, sponsors could rely on an annual salary figure stated in the contract of employment. From 8 April, UKVI can review specific pay periods—weekly, fortnightly, or monthly—to determine whether the minimum salary requirement has been met for each defined cycle. For monthly-paid employees, UKVI will check that total salary in any three-month period meets at least one quarter of the annual Certificate of Sponsorship salary. Non-compliance may trigger prompt enforcement action from UKVI, including sponsor licence suspension or revocation.
The new rules particularly affect workers with variable pay structures, such as those on commission, shift patterns, or roles with fluctuating hours. HR and payroll teams now need to ensure that sponsored employees meet the threshold in every pay cycle, significantly increasing compliance workloads. Employers who assigned a Certificate of Sponsorship before 8 April 2026 benefit from transitional protection, meaning the old rules apply to those applications.
What it means for you
If you hold a Skilled Worker visa or are applying for one, your employer must now guarantee that your salary meets the required minimum in every pay period—not just on average across the year. If you're on a variable-pay contract, ask your HR team to confirm your payroll structure is compliant under the new rules. Workers whose pay dips below the threshold in any given period could see their visa or extension refused, even if their annual salary is correct.
