Immigrant Healthcare Coverage Facing Major Restrictions in 2026–2027
Lawfully present immigrants, including green-card holders and asylees, are losing access to affordable healthcare. Starting January 1, 2027, only narrowly defined immigrant categories qualify for Marketplace subsidies; October 2026 saw Medicaid restrictions eliminating coverage for most humanitarian visa holders.
Sweeping changes to federal healthcare policy are dramatically narrowing the categories of immigrants eligible for Medicaid, Medicare, and subsidized ACA Marketplace coverage, affecting over 1 million lawfully present immigrants.
Changes Already in Effect
Lawfully present immigrants with incomes below 100% FPL had been eligible to receive tax credits if they were ineligible for Medicaid based on immigration status, for example due to being in the five-year waiting period for Medicaid or CHIP or because they did not have a "qualified" status. However, this coverage was eliminated effective January 1, 2026, under the 2025 reconciliation law.
As of August 25, 2025, Deferred Action for Childhood Arrivals (DACA) recipients are no longer eligible for Marketplace coverage.
Changes Coming January 1, 2027
Beginning January 1, 2027, people with lawfully present immigration statuses remain eligible to purchase marketplace coverage, but only U.S. citizens or nationals and those who meet the new narrow immigrant group restriction are eligible for PTC and CSR (premium tax credits and cost-sharing reductions).
More than 1 million lawfully present immigrants will lose access to affordable marketplace health coverage, Medicaid, and Medicare, beginning in 2026, as a result of H.R. 1 and a new federal rule.
Who Still Qualifies
When you apply for 2026 coverage, you'll need to show that your income is at or above the federal poverty level. Lawful permanent resident adults (Green Card holders) who have met the 5-year waiting period, Cubans or Haitians, with a range of current or past statuses, and People from Micronesia, Palau, or the Marshall Islands living in the U.S. may still qualify with subsidies, though additional restrictions apply in 2027.
What this means for you: If you are a refugee, asylee, or hold Temporary Protected Status (TPS), you will lose access to Marketplace subsidies starting the 2027 plan year. Enroll during the 2026 open enrollment period (November 1 – January 15, 2026) if you haven't already done so. As a green-card holder within your five-year waiting period earning below poverty level, you have lost subsidy eligibility as of January 2026—your only option now is full-price Marketplace plans or state-funded programs in a few states like California and Colorado. Document your immigration status and eligibility category immediately; you may qualify under narrower pathways if you fall into specific humanitarian categories.
